Bobby Brown in Court: 'I Just Miss My Daughter'

Bobby Brown went to court Friday in Orange County, Calif., seeking legal and physical custody of his 14-year-old daughter with Whitney Houston, telling PEOPLE, "I just miss my daughter."

"I miss watching her sleep, making her laugh, everything, it's the simple things," Brown said after a court hearing for custody of Bobbi Kristina. "She looks like me - it's like looking in the mirror. The goal is to see her a lot more and to be involved in the decision making in her life, the places she goes, the people she hangs out with. All of that."

For now, he will have to wait until Oct. 22 before any custody decision is made: The judge on Friday called for both Brown and Houston to personally argue their cases in a deposition.

Houston did not appear in court, and her lawyers had no comment afterward, saying they're awaiting the October deposition. Brown, wearing a grey pinstriped suit, purple shirt and tie, said mid-hearing, "I'm looking forward to my day in court, hopefully it will come."

The judge called for deposition at the same courthouse in Orange Couty. Houston, however, will be allowed to tape hers, as she and Bobbi Kristina have moved to Atlanta, where the pop star is currently recording.

Though the pair were recently photographed together at a restaurant in Georgia, recent court documents show that Brown, 40, and Houston, 44, are still not seeing eye-to-eye. Brown claimed in legal papers last month that "Since Whitney has been awarded sole legal and physical custody of Bobbi Kris, she has attempted to eliminate me from Bobbi Kris's life."

Added Brown on Friday: "I just want to be there to help her make the right decisions and be her father."

Brown's lawyers on Friday claimed that Houston flew Brown out to Atlanta two days ago to spend time with his daughter, and that Houston told him not to appear at the court hearing. His lawyers also said of his trip to Atlanta: "He thought they were still working on their marriage. She is the woman he loves."

With his head down and a mopey look on his face, Bobby Brown walked into a packed Orange County Superior Court just moments ago -- to fight Whitney Houston for partial custody of their 14-year-old daughter, Bobbi Kris.

Brown, who rocked a sharp, pinstriped suit with a stylish purple tie, is hoping to overturn a default judgment that ended his marriage to Whitney and gave her sole custody of their daughter.

When asked about what he expected to get out of today's hearing, Brown simply responded, "No comment."

Inside the courtroom, the judge set up the ultimate showdown -- when she ordered both Bobby and Whitney into court to see who's the more credible parent -- in person. But a short time later the plans may have changed, when the judge considered Houston's request to videotape her deposition and send it in instead. Whitney's lawyers argued that the former diva is in the middle of hammering out a new record deal in Atlanta ... and can't be bothered.

As Bobby made his way out of court, he told TMZ, "I can't wait for this to be over." The next court date has been set for Oct. 22.

Somebody signed Bobby Brown's name on a prenuptial agreement with Whitney Houston -- but Bobby claims it wasn't him!

Just moments ago, Brown's lawyer, Stacy D. Phillips, told an Orange County Superior Court judge that she had an issue with the prenuptial agreement that Houston's legal team brought up earlier this week.

According to Brown's attorney, Bobby is prepared to take the stand and tell the judge that "It is not his signature" on the document.

Outside the courtroom, Bobby told TMZ, "I just want to see her [daughter Bobbi Kristina] more often and make decisions in her life."

Bobby Fights For Custody

The ongoing divorce and custody battle between Bobby Brown and Whitney Houston has just gotten worse, with Brown claiming that at one point, he lived in his car.

TMZ obtained court documents, outlining their rocky relationship since they separated. Brown alleges Whitney won't let their daughter, Bobbi Kris, return his calls. Bobby says, "Whitney has blocked my number." He also touches on his grim financial situation, saying that he paid "approximately $10,000 for Whitney and Bobby Kris to live in a nice hotel while Whitney was going through rehab. At the same time, I basically lived in my car."

The prenup is in the filing, which says Bobby can't get alimony or support.

As TMZ first reported, the odd couple was spotted in Georgia at Joe's Crab Shack earlier this month, smiling!

The Browns return to divorce court on Friday, August 31.

'Irresponsible' photo op?

Atlanta attorney Phaedra C. Parks came out swinging Thursday after Tmz.com published a camera-phone image of her client Bobby Brown and ex-wife Whitney Houston taken Tuesday night at Joe's Crab Shack in Alpharetta and hinted that the pair was high. Tmz.com also sent out a news alert to e-mail subscribers with the headline: "Whitney and Bobby: Livin' the High Life Again."

"It's incredibly irresponsible of Tmz.com to take cheap potshots at people who have experienced problems in their past," Parks told us. "My phone has been ringing all day. Bobby asked me, 'What are they saying?' I had to tell him, 'They're saying you were high.' 'He replied, 'Oh my God, that's terrible.'"

Parks says that the parents of Bobbi Kristina are in town this week to help their daughter enter high school here.

"They are both sober and they're both trying to have positive careers," Parks said. "This is extremely unfair to both of them. She's a mother. He's a father. And they're here trying to be good parents. It was just an easy thing for Tmz to tag them with."

Brown told Parks that while they were eating at the Haynes Bridge Road restaurant, another patron approached them with a camera phone and started snapping images.

When contacted by Buzz on Thursday, a manager at Joe's Crab Shack told us that Houston and Brown were cordial and friendly during their visit and that no one working the shift reported either pop star as being impaired.

While the singers maintain ties to Atlanta, the couple's former residence at Country Club of the South was sold in May for $1.1 million.

Bobby & Whitney: Spotted Together

Whitney Houston and Bobby Brown had dinner together on Tuesday night – but that doesn't mean the former husband and wife are getting back together.

Patrons at Joe's Crab Shack in Alpharetta, Ga., were surprised when Brown and Houston – who divorced in April – showed up together.

Sitting at a table near the window and dressed casually, the couple – whose photograph was obtained by TMZ.com – appeared to be engaged in pleasant conversation during their seafood and salad dinners. They even posed together for pictures with autograph seekers.

"They did eat here," the restaurant's general manager, David Evans, confirms to PEOPLE, "and they seemed to enjoy their meal."

Although in May Brown, 38, sued Houston, 44, for spousal support, child support and shared custody, a source close to the two says that the former couple have remained close. In February, they also shared a dinner, for the sake of daughter Bobbi Kristina, 14.

"They're still on good terms," says a relative of Brown's. "They don't hate each other."

Just don't expect a reconciliation anytime soon. "[Getting back together] is the furthest thing from their mind," says the family member. "That's just not in the cards. They've got a history together, so they've got a lot to talk about. It's as simple as that."

Bobby arrived wearing loose fitting white pants, a white-checkered/striped shirt and a white matching Kangol looking very Poloish. I was lucky to be seated in a prime seating area because every chair was in-demand. Andre Russell from KJLH, the host of the night, let everyone know that Bobby was in the house and that he had entered through the front door and not the back artist entrance. But that's how Bobby does things, he enters through the front. Once on stage, Bobby began to metamorphose into Bobby the performer, the alter-persona and you knew this was no conservative party. He was still the Bobby Brown who's going to jam. The side of Bobby that is ready to cause an artistic explosion on stage at any given moment was evident. From the onset of his performance, Bobby told the audience that he didn't like to see people sitting down and so he demanded that everyone "...get your a#% up" and everyone got up.
